Florida power of attorney notarization
Florida's statutory durable power of attorney (Fla. Stat. Ch. 709, Part II) is not a notary-only job. The principal must sign, two qualifying witnesses must sign, and the principal's signature must be acknowledged before a Florida notary (see § 709.2105). Skip the witnesses and the form is defective. Healthcare designations (healthcare surrogate, living will) live in Chapter 765 and have their own witness rules.
How the appointment works
- Use a current Florida durable POA and, if needed, healthcare surrogate and living will forms. Fill blanks except signature lines.
- Arrange two qualifying witnesses who are not the named agent. Neighbors, friends, or building staff are the usual fix.
- Bring the principal's photo ID. Do not pre-sign.
- The principal signs. The two witnesses sign. The Florida notary takes the principal's acknowledgment.
- Ask the bank, HOA, or title company how many originals they need before the notary leaves.
Bring two witnesses
Arrange two qualifying witnesses before the notary arrives. The agent named in the POA is a poor witness choice. Neighbors, friends, or building staff who are not named in the document are the usual fix in Miami condos, Naples kitchens, and Orlando hospital rooms. The notary completes the acknowledgment. They do not magically supply missing witnesses unless someone present is eligible and willing.
Do not plan on the notary serving as one of the two witnesses. Book two other people. If a special rule on your form says otherwise, follow that form and Florida law, not a forum post.
Healthcare vs durable POA
A durable POA is money, property, and often real estate. A healthcare surrogate designation is medical decisions. A living will is treatment preferences. Florida retirees in Sarasota, Boca, and The Villages often sign all three in one visit. Read each execution block. Do not assume one notary stamp covers every page that still needs witnesses.
Chapter 765 healthcare forms are witness-driven. A notary is commonly added so hospitals accept the packet without a callback. That is practice, not a substitute for the witnesses the statute names.
Snowbirds, RON, and originals
Property-management POAs for a Florida condo while the owner is in Ontario still have to meet Chapter 709 if they are Florida durable POAs. Florida RON can work only if the platform can take the required witnesses remotely and the receiving party will accept a Florida online certificate. Many title companies and HOA packets still want wet ink.
After the appointment, keep an original. Give the agent a copy. If the POA will be used to sell Florida real estate, send it to the title company before the closing date, not the morning of funding.
