    California power of attorney notarization

    A California notary acknowledges the principal's signature. They do not draft the POA. Uniform statutory form POAs live in Probate Code § 4400 et seq. A power of attorney can be signed with two witnesses or acknowledged before a notary (Probate Code § 4121). Banks, title companies, and county recorders almost always want the notarized version. When a notary takes a POA, Cal. Gov. Code § 8206 requires a journal thumbprint.

    How the appointment works

    1. Use a current California statutory POA and/or Advance Health Care Directive. Initial the powers with counsel first. Leave signature lines blank.
    2. Bring current California-acceptable photo ID. Expect a right-thumbprint in the notary journal for a POA.
    3. Do not pre-sign. Sign in front of the California notary.
    4. If you need extra originals or a certified copy of the POA, say so before the notary leaves. California notaries may certify a copy of a POA (Probate Code § 4307).
    5. Book mobile in person. California-commissioned notaries cannot perform RON as of 2026.

    Thumbprint and certified copies

    Expect a right-thumbprint in the notary journal for a power of attorney. If that thumb is unavailable, another finger is noted. Statutory notary fee is $15 per signature, including certifying a copy of a POA (Gov. Code § 8211). California is one of the few states where a notary may certify a copy of a power of attorney. They still cannot certify a copy of a birth certificate.

    Advance health care directive

    A California Advance Health Care Directive (Probate Code § 4701) can be signed with two qualified witnesses or acknowledged before a notary. Witness-eligibility rules disqualify the agent, the treating provider, and operators of the facility where the principal lives. Many families book a notary at Cedars-Sinai, UCLA, or a Pasadena assisted-living unit to avoid that trap. A living will-style instruction can sit in the same AHCD packet. It is still not a financial POA.

    No California RON

    California-commissioned notaries cannot perform remote online notarization as of 2026 (SB 696 / Gov. Code § 8231.2, statutory backstop January 1, 2030). Book mobile, in person. An out-of-state RON session is a different state's certificate. California county recorders generally will not take that for a document that must record here.
